Mr. Anderson -
Thank you for your email and interest in OPKO.
My understanding is that there was an inadvertent error and that is why it was corrected.
Kind regards,
Yvonne

Subject: SEC Filings
Yvonne,
I know that this was brought to your attention shortly after the ModeX acquisition. I also know that shortly thereafter the filings were all changed to remove Gary Nabel’s name.
That doesn’t answer the question of why was he filing SEC documents on behalf of Opko in the first place.
What was his relationship, connection or employment arrangement with Opko during this period? Why the hurry to go and remove his name from the filings?
Thanks,
Bill Anderson

Shady as it gets.
You just happen to have one of the principals of your newly acquired ModeX operation filing SEC documents on behalf of the company and your explanation is an inadvertent error.
I believe ModeX to be the best hope we have for a future pipeline so I’m very happy with the acquisition. But why the cover up here, why not just admit what I’m fairly certain I know happened?
Like a bad infomercial, but wait there’s more…..

In August 2020, Dr. Phillip Frost, our Chairman and Chief Executive Officer, paid a filing fee of $280,000 to the FTC under the HSR Act in connection with filings made by us and Dr. Frost, relating to his percentage equity ownership interest in OPKO and potential future purchases of our Common Stock. We reimbursed Dr. Frost for the HSR filing fee.
